South Carolina insurance regulators have filed suit in Richland County seeking an emergency takeover of a Charleston-based insurance company, alleging the firm loaded its books with high-risk, underperforming investments that threaten its ability to pay claims.
The action targets Atlantic Coast Life Insurance, which state officials say could leave up to 50,000 customers holding retirement-income products and more than 100,000 policyholders with funeral and life coverage exposed if the company’s finances continue to deteriorate. Regulators are asking a judge to place the insurer into a form of court-supervised receivership so its assets and obligations can be managed while the underlying investment concerns are sorted out.
The filing marks one of the more significant state insurance interventions in South Carolina in recent memory given the scale of the customer base involved. Funeral and burial policies, in particular, tend to be held by older residents who rely on them to cover final expenses, and any disruption to claims-paying ability draws close scrutiny from regulators tasked with protecting policyholders ahead of a company’s owners or creditors.
For a company headquartered in Charleston, the case also puts a spotlight on how state-level financial oversight works when a hometown insurer’s investment strategy comes under question, and on what protections remain in place for customers while the legal process plays out.
