What is NIL?
Name, Image
& Likeness

NIL stands for Name, Image, and Likeness — an athlete’s right to earn compensation when a third party uses their name, image, or likeness (endorsements, social posts, appearances, camps, autographs). In South Carolina, college NIL is governed by S.C. Code Ann. §§ 59-158-10 et seq.read the full statute. High-school NIL is permitted in South Carolina under conditions set by the South Carolina High School League (SCHSL) (SCHSL By-Laws, Article III — Student Eligibility, Section 14 (Amateur Status)). What the Statute Says

2021 Act No. 35 (S.685), eff. July 1, 2021 · Amended 2024 Act No. 207 (H.4957), eff. May 21, 2024

College Athletes May:
  • Earn compensation for the use of their name, image, or likeness, independent of athletic participation or performance (§ 59-158-20).
  • Sign NIL contracts (endorsements included) with third parties for the period of their eligibility (§ 59-158-30).
  • Use a school’s trademarks and facilities in NIL activities only if the institution grants permission (§ 59-158-20).
  • Be represented by an athlete agent registered with the SC Department of Consumer Affairs under § 59-102-60 or § 59-102-80; if the agent is an attorney they must be a member in good standing of a state bar (§ 59-158-10).
Prohibited:
  • Endorsements for tobacco, alcohol, illegal substances or activities, banned athletic substances, or gambling (including sports betting) (§ 59-158-20).
  • NIL contracts that extend beyond the athlete’s eligibility to participate (§ 59-158-30).
  • Compensation for athletic participation or performance, except as permitted by collegiate-athletic-association/institution policy, court order, or settlement (§ 59-158-20).

HIGH-SCHOOL NIL — South Carolina High School League (SCHSL) RULES
Conditions for HS Athletes

SCHSL By-Laws, Article III — Student Eligibility, Section 14 (Amateur Status)

Effective with the 2024–25 SCHSL Legislative Assembly bylaw amendment, SC high-school athletes may earn NIL compensation under Article III, Section 14 of the SCHSL By-Laws, subject to strict conditions.

Conditions:
  • Compensation must NOT be contingent on athletic performance or achievement.
  • Compensation must NOT be an incentive to enroll or remain enrolled at a specific school.
  • Compensation must NOT be provided by the school or any person acting as an agent for the school.
  • No school “marks” (logos, name, mascot) or SCHSL logos/acronyms may be used.
  • No school apparel or equipment bearing school name/logo/mascot or SCHSL logos may be worn.
  • No member-school facility may be used for NIL compensation.
  • No activities in conflict with the local school district’s policy may be endorsed (examples include tobacco and alcohol products).
Penalties for Violations:
  • First violation: formal warning; must return any award/money and remove the endorsement/sponsorship.
  • Second violation: one (1) year of ineligibility from all SCHSL interscholastic athletics from the date of determination.
  • Third violation: penalty determined by SCHSL based on nature, knowledge, and intent of the violation.

NCAA NIL POLICY — APPLIES TO ALL CHARLESTON COLLEGE PROGRAMS
NCAA Name, Image, Likeness (NIL) — interim & ongoing policy

NCAA rules apply alongside state law; athletes should review both their campus NIL policy and applicable state law, and consult their compliance office or Faculty Athletics Representative (FAR).

NCAA Says Allowed:
  • Compensation specifically for use of the athlete's NIL (ads, posts, appearances).
  • Deals with a valid business purpose tied to a real product, service, or event offered to the public.
  • Compensation within a reasonable range for people with similar fame or influence.
  • Use of an agent or marketing professional for NIL services.
NCAA Says Not Allowed:
  • Pay with no required promotional activity or deliverables.
  • Agreements that say the athlete's NIL will be used later with no defined plan.
  • Pay-for-play, including payment to attend or compete for a specific school, or compensation for athletics participation or achievement.
  • Compensation outside a reasonable range for similar deals.
Disclosure (Division I):

Division I athletes must report all third-party NIL deals worth $600 or more (aggregate smaller payments from the same payer that total $600 or more) via NIL Go, the College Sports Commission's compliance-review platform.
